  1. Data Collection
  2. Laguna Jobs collect Personal Data and Anonymous Data from you when you use our mobile applications and when you send us information or communications:

    “Personal Data” means data that allows someone to identify or contact you, including, for example, your name, phone number, ID Card number, zip code, location, bank account number and e-mail address.

    “Anonymous Data” means data about you that is not associated with or linked to your Personal Data.

    We collect Personal Data from you, such as first and last name, gender, birth date, phone number, e-mail address, education, ID Card number or Passport number and password when you use our mobile applications or services in our support system. In addition, we may collect Personal Data including your work certificate which include identity card, driver license (for any job that required), also bank account (after you finished your job and we transfer money to your account). We also retain information on your behalf, such as the Personal Data, sensitive data described above and any correspondence.


  3. Consent and Collection Permission to Collect Information
  4. Giving consent or the creation of personal and anonymous information through the application of Laguna Jobs will show that users

    1. Voluntarily to Consent to Laguna Jobs and its group companies, to collect, uses and processes personal data of its users. For the purposes stated below,
    2. Consent to Laguna Jobs and its group companies to disclose of personal information of service users to a third party, representative service provider of Laguna Jobs and group companies (Whether in or outside Thailand) for the purposes as stated below

    Under this privacy policy, the following words have the meanings mentioned below. Unless otherwise specified

    "Laguna Jobs" or "the company" or "us" means the company Laguna Jobs Company Limited.

    "Service" means the services offered on the website. On the mobile application Or other Laguna Jobs services such as information, content and other media provided by Laguna Jobs. For the benefit of member users and general users that they offer both free and paid services.

    "Jobs" means the act of providing a service or any other act agreed upon through a Laguna Jobs application.

    "User" means a job seeker (Talent) and Employer (Business Partner) who accepting the terms of use and register to use the app

    "Talent seekers" are users who agree to find a job and provide services to others by publishing information Profile information via application or any other means of contact in the future

    “Employer” (Business Partner) is a user who is an organization, company, juristic person, or recruiting service provider that may be advertised about the position or advertise to promote the company or the job of the company or customers through the website or other services of the company and agree to hire a job seeker (Talent) to perform as agreed on the terms of service via the application or any other means of contact in the future

    "Register" refers to the steps that user takes to become a member by disclosing information to Laguna Jobs and allow the company to keep details Including but not limited to Personal information, Resume, Profile Information and Job advertising for Employer (Business Partner) or advertisers in the system for the benefit of job searching procurement and employment

    "Data" or "Profile information" is the details of the Talent and Business Partner who have accepted the Application Agreement and have created an account and enter information as specified by the company and be able to show.

    "Serious offense" is an offense that the company is responsible for and announces that any action is a serious offense. If any user violates or committing a serious offense, the company can immediately suspend its use including deleting the account from the system In the event that a serious offense affects the company, the company reserves the right to prosecute both civil and criminal and claim damages from such action.

    "Hiring" means an agreement between job seeker (Talent) and employer (Business Partner) on job scopes and conditions.

    “Income” means the money that Talent will receive upon delivery of a job or has provided complete services to an employer (Business Partner) as agreed on application.

    "Wage rate" is the wage rate that the employer offers to the job seeker, which the company reserves the right to refuse / or cancel job advertising of the position that offered wages lower than the minimum wage price by law.

    “Laguna Alumni Score” or “Ex-Laguna Employee Score” is the average past performance rating score when Talent working within the group of Laguna Resorts & Hotels (Public) Co., Ltd. This score will help increase the credibility of the Talent and for business partners to consider before hiring. The company reserves the right, in its sole discretion, not to provide information, ratings, opinions, feedback and some suggestions in the system

    “Laguna Jobs Review” or “Laguna Jobs Rating” is the process after the Talent has delivered or completed a service and employer (Business Partners) accept work to assess satisfaction, including comments, criticism, and suggestions for further improvement of the quality. This score will help increase the credibility of the Talent and for business partners to consider before hiring. Rating information will not be deleted from the system, but the company reserves the right, in its sole discretion, not to display certain ratings, comments, feedback, and suggestions in the system.

    “Verified Talent” means a job seeker (Talent) who has submitted a complete set of documents including ID card information, contact details, photo, address and all information used to verify identity as specified by the company to help employer (Business Partner) decide to hire or use the service.

  5. Use of Data
  6. Personal information permitted by the user in connection with the generated offers or provide for mobile applications, the company uses personal information as follows:


    1. To create and maintain user accounts.
    2. For various management purposes of the Company's service
    3. To identify the User for a user account on the Company's system.
    4. To send an email to confirm the user's email address, when creating a new user account
    5. To send notifications
    6. To provide job alerts suitable for the user.
    7. To pay for the labor of the work.
    8. To prioritize work experience
    9. To publicize news to users.
    10. To increase the ease of searching, recruitment of entrepreneurs (business partner), disclosure of detailed and complete information such as contact information, work history and the education history of the job seeker (Talent) which will create more opportunity to the job seeker (Talent) and more convenient to search for talent for entrepreneur (business partner).
    11. For data usage analysis report
    12. To contact user relatives or contact persons in emergency cases i.e. emergency contacts of employees

    The company may create Anonymous Data records from Personal Data by excluding information (such as first and last name) that makes the data personally identifiable to you. We use this Anonymous Data to track usage patterns so that we may enhance our Services and improve site navigation. We reserve the right to use Anonymous Data for other purposes and to disclose Anonymous Data to third parties by our discretion.

    If a user has given feedback on the system For Laguna Jobs, the company will use feedback for various purposes. Feedback is not linked to users' personal information. In the user's personal information record, this will maintain the communication of the user and will treat the communication of the user in accordance with this Privacy Policy.

    If you provide feedback on our Laguna Jobs Services, we may use such feedback for any purpose, provided we will not associate such feedback with your Personal Data. We will collect any information contained in such feedback with your Personal Data.     If Laguna Jobs is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on mobile applications of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

    Except as otherwise started in this Privacy Policy, we do not sell, trade, share, or rent the Personal Data collected from our services to third parties other than as outlined in this Privacy Policy. You expressly consent to the sharing of your Personal Data as described in this Privacy Policy.

    After the user has read this privacy policy, when you complete your profile and information and press register voluntarily. This is considered that you consent to the company to collect your personal information. But if you do not allow, please discontinue to use Laguna Jobs application immediately.

    After verifying your identity, if after the company detects that you have provided all or part of your false personal information, the Company will temporarily suspend the use of your account. And you must submit evidence to verify the accuracy of the personal information within 15 days from the date of discovery. If the deadline is over, the company reserves the right to delete your account and is not responsible for any damages incurred.

    Users may change some parts of your Personal Data in your account via our mobile applications or by sending an e-mail to us lagunajobs@lagunaphuket.com. You may request to delete your account by sending us an e-mail but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information in certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). We will respond to access to Personal Data within 30 days. When we delete your account information, it will be deleted from the active database, but may remain in our archives.

  7. Personal information of persons under the age of 18
  8. Our website and application do not refer to anyone under the age of 18. If anyone under the age of 18 has provided us with personal information, it shall be deemed that the parents have warranted and guaranteed that the user is consenting to the collection, use of the disclosure of personal information as described in this Privacy Policy.

  9. Disclose or share collected personal data
  10. Company may disclose to or share user collected personal data with other third parties to achieve the specific purposes for which the personal data was collected. The third parties who we may disclose or share user collected personal data with may include:

We may transfer user collected general personal data and/or sensitive personal data to group companies or third parties located in countries outside Thailand for the purposes prescribed in this Privacy Policy. We will only transfer user collected personal data to a country that, in the view of the Thai Personal Data Protection Commission, has adequate data protection or privacy laws. Where such data security standards are deemed inadequate, we will provide appropriate safeguards to protect user interest or the transfer will take place if one of the exceptions defined by the PDPA is met. The exceptions are where:

    1. the transfer is necessary for compliance with the law;
    2. user have explicitly consented to the proposed transfer after having been informed of the possible risks of such transfer due to the absence of adequate security standards or safeguards;
    3. the transfer is necessary for the performance of a contract with user or the implementation of pre-contractual measures taken at user’s request;
    4. the transfer is necessary for the conclusion or performance of a contract in user interest between us and another natural or legal person;
    5. the transfer is necessary to protect user vital interests or those of other persons, and the data subject is incapable of giving consent; or
    6. the transfer is necessary for important reasons of public interest.

  13. Inform about User Personal Data
  14. Before or at the time of collecting user personal data, we will always inform user of our purposes of processing user personal data. Only in some circumstances, it is not necessary for us to inform you of our processing purposes, such as when:

    1. user are already aware of such new purposes or details of processing of user personal data;
    2. we believe that notice of such new purposes or the details of our processing is impossible or will obstruct the use or disclosure of user personal data, where we have taken suitable measures to protect user rights, freedoms and interests;
    3. it is urgent to use or disclose user collected personal data as required by law and we have implemented suitable measures to protect user interests; or
    4. we are aware of or acquire user personal data from our duty, occupation or profession, and we have maintained such new purposes or certain details with confidentiality as required by law.

  15. Rights under the PDPA
  16. Under the PDPA, user have the following rights in respect of user personal data:

    1. Right to access
    2. User have a right to access and obtain a copy of personal data that we hold about user, or user may ask us to disclose the sources of where we obtained user collected personal data that user have not given consent. We will respond to user request as soon as reasonably possible but not exceeding thirty (30) days after receiving user request.

    3. Right to data portability
    4. User have a right to request us to transfer user collected personal data to other persons/organisations, or request to see user collected personal data that we have transferred to other persons/organisations, unless it is impossible due to technical circumstances.

    5. Right to object to the processing of your collected personal data
    6. User have a right to object to the processing of user collected personal data, unless there are circumstances that do not allow user to make the objection. This may include when we have compelling legitimate grounds or when the processing of user collected personal data is carried out to comply, exercise or defend legal claims or for our public interest.

    7. Right to delete
    8. Users have a right to request us to delete, destroy or anonymise user collected personal data in the following circumstances where:

      1. a) User collected personal data is no longer necessary for the purpose for which it was collected, used or disclosed;
      2. b) User have withdrawn user consent to which the collection, use or disclosure is based on and we do not have legal grounds to collect, use or disclose user collected personal data;
      3. c) User have objected to the collection, use or disclosure of user collected personal data and we do not have legal grounds to reject user request; and/or
      4. d) User personal data has been unlawfully collected, used or disclosed under the PDPA.

    9. Right to restrict the processing of user collected personal data
    10. User have a right to request us to restrict the processing of user collected personal data in the circumstances when:

      1. a) It is under the pending examination process of checking whether user collected personal data is accurate, up-to-date, complete and not misleading;
      2. b)It is user collected personal data that should be deleted or destroyed as it does not comply with the laws, but user request to restrict it instead;
      3. c) User collected personal data is no longer necessary to be retained for the purpose for which it was collected, used or disclosed, but you still have the necessity to request the retention for the purposes of the establishment, compliance, exercise of legal claims or the defence of legal claims; and/or
      4. d) We are pending verification in order to reject the objection request to the collection, use or disclosure of user collected personal data.
    11. Right to rectification
    12. Users have a right to rectify inaccurate personal data in order to make it accurate, up-to-date, complete and not misleading. If we reject user request, we will record such rejection with reasons.

    13. Right to lodge a complaint
    14. User have a right to make a complaint in the case of where we, our data processors including our employees or contractors do not comply with the PDPA or other notifications or announcements under the PDPA.

    15. Right to withdraw consent
    16. User may withdraw user consent at any time, unless we have a lawful basis to deny user request. We would like to also inform user that user consent withdrawal may affect our relationships with user or the products and/or the services that will be provided to user by us. This is because, for instance, the personal data, if remaining after consent withdrawal, may be insufficient for us to render complete services that user need, or we may need time to request additional information from user. If user change mind about how user would like us to have or process user collected personal data and would like to withdraw user consent, user can tell us anytime by following our withdrawal process at account deletion feature in our application. Upon our receipt of a request to exercise user rights, we may, in certain cases, request additional information in order to confirm user identity and your rights as part of our security measures.


  17. Period of retention of Personal data
  18. We will only retain user collected personal data for as long as it is necessary for the specific purposes for which the personal data was collected. This means that the retention periods will vary according to the type of user collected personal data and the purpose or reason that we collect the personal data. If we do need to keep user collected personal data for a longer period to comply with the legal obligation, or if some existing claims or complaints will reasonably require us to keep user personal data or for regulatory or technical reasons, we will continue to protect that collected personal data. We have procedures in place regarding our retention periods, which are kept under constant review, taking into account the purposes for processing user collected personal data and the lawful basis for doing so. We will delete, destroy, permanently anonymise or otherwise dispose of all collected personal data at the end of the retention period, or when we must comply with user request for erasure of user collected personal data.   19. Use of Cookies
    1. When user interact with us on our websites, we automatically receive and record information on our server logs from user browser. We may employ cookies in order for our server to recognize a return visitor as a unique user including, without limitation, monitoring information relating to how a visitor arrives at the website, what kind of browser a visitor is on, what operating system a visitor is using, a visitor’s IP address, and a visitor’s click stream information and time stamp (for example, which pages they have viewed, the time the pages were accessed and the time spent per web page).

    1. Laguna Jobs will take reasonable efforts to protect Personal Data in our possession or our control by making reasonable security arrangements to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks. However, we cannot completely guarantee the security of any Personal Data we may have collected from or about user, or that for example no harmful code will enter our website (for example viruses, bugs, trojan horses, spyware or adware). User should be aware of the risks associated with using websites.
    2. While we strive to protect user Personal Data, we cannot ensure the security of the information user transmit to us via the Internet or use our mobile services, and we urge you to take every precaution to protect user Personal Data when user use such platforms. We recommend that user change user passwords often, use a combination of letters and numbers, and ensure that user use a secure browser.
    3. If applicable, user undertake to keep user username and password secure and confidential and shall not disclose or permit it to be disclosed to any unauthorised person, and to inform us as soon as reasonably practicable if user know or suspect that someone else knows user username and password or believe the confidentiality of user username and password has been lost, stolen or compromised in any way or that actual or possible unauthorised transactions have taken place. We are not liable for any damages resulting from any security breaches, on unauthorised and/or fraudulent use of user username and password.

    13.3 If user withdraw user consent to any or all use of user Personal Data, depending on the nature of user request, Laguna Jobs may not be in a position to continue to provide its products and services to user, administer any contractual relationship in place, which in turn may also result in the termination of any agreements with Laguna Jobs, and user being in breach of user contractual obligations or undertakings. Laguna Jobs’ legal rights and remedies in such event are expressly reserved.


  25. Governing Law
  26. 14.1 This Data Protection Policy and user use of this website shall be governed in all respects by the laws of Thailand.
